Insurance Terms

THIRD PARTY AUTO LIABILITY INSURANCE TERMS provided by Riders Share

DISCLAIMER: Riders Share’s Policy (the “Policy”) does not replace the need for Renters and Owners to satisfy financial responsibility requirements outside of a rental transaction. Renters and Owners (collectively “Users”) do not pay towards the Policy and are not insured under the Policy. The Policy has limits in place and is not guaranteed to respond above the limits. This is a summary of Riders Share’s insurance Policy. These terms apply to all Riders Share users. These terms may be updated on a routine basis. The following applies to coverage for our Users based on Riders Share’s insurance Policy.

 

Owner Insurance Selection*

Owners can select from 3 Insurance Options

Standard (30%):  Under this plan, your transactions are covered by Riders Share's general liability protection policy of up to $300,000 and for comprehensive & collision coverage up to $30,000, as well as state minimum requirements for 3rd party liability.

If you attain and maintain Power Host status, this rate is reduced to 25%.

 Premium (40%): same coverage as Standard, plus mechanical breakdown coverage and loss of use coverage up to 14 days.

 Commercial (15%): If you have existing commercial insurance, liability protection and roadside assistance for your vehicle, you may decline Riders Share's coverage.

General

Users are covered through the Riders Share insurance Policy which automatically includes state minimums for liability as further discussed below. Insurance coverage through the Riders Share Policy does not replace your personal insurance policy, until the commencement of the Rental Period. All Riders Share users, Owners and Renters are advised to retain personal insurance that meets their needs. Prior to the beginning of the Rental Period, and during delivery and drop-off vehicles may not be covered by the Policy.

Riders Share has taken out a Policy which is designed to also provide protection for Renters (up to the “MFR”*) and Owners (up to USD 300,000) during the “Rental Period” for the liability arising out of the Rental.

 *MFR: Minimum Financial Requirement as set by each individual State. 

 “Rental Period” means the period of time during which the Renter has taken possession of and had permission to use a covered “motorcycle” pursuant to an in-force Reservation Agreement with Riders Share.  The “Rental Period” ends immediately upon return of the “motorcycle” or termination by you of the Reservation Agreement.

 “Motorcycle" means a two or three wheeled vehicle that is powered by a motor and has no pedals.

Outside a Rental period, Riders Share assumes no duty or obligation to ensure the sufficiency of your insurance coverage and cannot undertake to give advice regarding Users’ personal policy or state and local laws. Riders Share may, at their discretion, ask users to provide documentation of coverage, particularly commercial coverage when waiving other insurance options.

 

FOR OWNERS:

All qualifying vehicles that you have listed on Riders Share will be eligible for coverage, through the Riders Share Policy so long as the information you have provided is accurate, complete and up to date, except for those under the Commercial Plan.

Owners with User accounts that are in compliance with all Riders Share Terms shall have coverage unless they select the Commercial Option. Owner insurance coverage is a benefit for your use of Riders Share Services, unless you explicitly decline it by selecting Commercial.

 However, it’s important to note that:

  • Riders Share assumes no duty or obligation to ensure the sufficiency of any insurance coverage and cannot undertake to give advice regarding your personal policy or state and local laws.

  • Only transactions made through Riders Share in the US qualify for coverage with the exception that no coverage is offered for vehicles in NY.

  • Vehicles must be legally registered, meet all safety standards, and must be certified and meet all listing criteria on Riders Share. 

  • All drivers, including the primary contract signer, must be approved through the Riders Share.

  • Coverage does not extend to vehicles entering Mexico.

  • Subject to the Owner Terms, you have been made aware of certain exclusions to coverage, and you are aware of other avenues of reimbursement and dispute resolution available through the platform, you acknowledge that you have reviewed and understand the relevant terms included therein. Such information, read in combination with these terms has given you sufficient information regarding the Policy and terms with respect to insurance matters.

  • Insurance coverages are not permitted for salvage title vehicles. For the avoidance of doubt salvage title vehicles are not permitted on the Riders Share platform and are therefore not eligible for any coverage.

  • You agree and acknowledge that Riders Share may require additional documentation at their discretion, conduct investigations and make determinations that shall be binding on Renter and Owner as set forth in the Riders Share Terms.

  • Damage as a result of vandalism and theft during the rental period must include a police report when submitting a claim, or the claim will not be accepted.

  • Off-road usage is a prohibited renter activity unless explicitly authorized by Riders Share in accordance with the Riders Share Off-Road Policy. Specifically Off-road use of rentals booked through the Riders Share platform is strictly prohibited unless: (1) the Owner specifically approves their listing for off road use through the Riders Share platform, (2) the Renter accepts Off-Road Policy terms, and (3) the Renter pays the additional, if applicable, Off-Road Use surcharge to extend damage protection.

Please be aware that the Insurance option selected when creating your listing will be locked in when you receive a booking request. Accordingly, select from the three following options as listed above and explained below:

Using Standard Coverage, or you may select our premium option which offers coverage for mechanical breakdown or loss of use up to 14 days. If have separate commercial coverage, Riders Share may accept sufficient proof of coverage, and allow you to decline insurance coverage. Proof of Commercial Insurance may be reviewed by Riders Share to determine the sufficiency of coverage.

 

FOR RENTERS

The insurance coverage, through the Riders Share Policy, shall provide you minimum state requirement coverage so long as you are in compliance with the Riders Share Terms, and you do not misuse the motorcycle during the rental period.

You also agree that as a Renter, your personal insurance, to the extent available, will act as primary to any coverage you have the benefit of through Riders Share.

However, it’s important to note that:

  • A condition of any coverage through the Riders Share Policy, or additional coverage, may require additional verification or records checks, upon reasonable belief that the information you provided at the time of registering your Renter’s account is not complete or current.

  • Riders Share does not provide insurance coverage for Passengers.

  • Some Renters believe they are covered by protection related to their credit card. This is often not the case, and you should consult with your credit card company before making such an assumption.

  • You agree and understand that insurance provided under the Riders Share Policy, or additional purchased coverage, is offered by Riders Share’s third-party partner. Although Riders Share is NOT the insurer, Riders Share in some cases may act as agent or representative in resolution of some matters, including Insurance Claims.

  • Subject to the Renters Terms, you have been made aware of certain exclusions to coverage, and you are aware of other avenues of reimbursement and dispute resolution available through the platform. You acknowledge that you have reviewed and understand the relevant terms included therein. Such information, read in combination with these terms has given you sufficient information regarding the Policy and terms with respect to insurance matters.

  • In resolution of some disputes, you agree and acknowledge that Riders Share may conduct investigations and make determinations that shall be binding on Renter and Owner as set forth in the Riders Share Terms.

  • Any coverage is only applicable to motorcycles rented for personal use.

  • Damage as a result of vandalism and theft during the rental period must include a police report when submitting a claim, or the claim will not be accepted.

  • Certain types of damage may be excluded from coverage, such as off-road or illegal usage.

  • You agree and accept that you assume all obligation to review the Terms of Service, including these insurance terms to the extent they provide a summary of the Insurance Policy.

COVERAGE LIMITS

 Our insurance program provides auto insurance coverage to renters and vehicles that are eligible under our Terms of Service. The liability provided complies fully with California Bill AB-1871 on personal vehicle sharing.

 

Third Party Liability Coverage

Renters and owners are provided the benefit of coverage under our insurance Policy up to the Minimum Financial Requirement as set by each individual State. 

Coverage includes third party bodily injury or property damage arising from an auto accident during the Rental Period.

Third Party Liability Coverage cannot be declined by a Renter or Owner. In the event an Owner uses the Commercial Insurance option, they acknowledge and agree that such policy shall contain sufficient third-party liability coverage.

 

FINANCIAL RESPONSIBILITY FOR PHYSICAL DAMAGE TO THE VEHICLE

Protection plans made available on Riders Share are separate and apart from any insurance coverages described above and address the Renters financial liability for any damage to the Vehicle. Please review the Renter and Owners policies as well as the Terms of Service for additional terms regarding reimbursement for damages, or charges incurred as agreed by the Parties during a transaction.

 

FOR OWNERS

Only transactions made through Riders Share in the US qualify for physical damage protection and no protection is offered for vehicles in NY.

Vehicles must be legally registered, meet all safety standards, and must be certified and meet all listing criteria on Riders Share, such as having less than 4 wheels.

Subject to the Owner Terms, you have been made aware of certain exclusions to protection, and you are aware of other avenues of reimbursement and dispute resolution available through the platform.

Physical damage protections are not permitted for salvage title vehicles. In resolution of some disputes, you agree and acknowledge that Riders Share may conduct investigations and make determinations that shall be binding on Owner as set forth in the Riders Share Terms.

Limit for damage/theft protection is lowest of Actual Cash Value or $30,000.

Aftermarket parts must be reported in order to be covered by the Riders Share physical protection plan. Failure to report aftermarket parts in the listing will result in no coverage for those parts in the event of damage.

In the event of an accident, you shall receive notification by email upon filing a claim that will contain information regarding the claim. Your timely response is expected, be aware that additional storage fees may apply and Riders Share does not cover them.

In the event of an accident, Owner has a duty to mitigate further damage to their vehicle

Damage as a result of vandalism and theft during the rental period must include a police report when submitting a claim to or the claim will not be accepted. In the event that the Renter fails to file a police report, or the police require the owner to file the report, Owner agrees to file the necessary police repot required to process the claim.

General Liability Coverage

Owners are provided the benefit of coverage up to USD 300,000 combined single limit.

Mechanical Breakdown Coverage

In the event of a mechanical breakdown occurring over the course of a transaction on Riders Share, Owners under the Premium plan will be reimbursed for the repairs associated with the mechanical breakdown. However, the owner must have a fully documented maintenance history according to OEM standards to qualify. This coverage does not include regular maintenance items such as tire replacement due to normal use.

Mechanical Breakdown Coverage Exclusions:

  • Parts that are subject to wear under normal riding conditions. Including, but not limited to: battery, battery cables, springs, shocks, spark plugs, spark plug wires, filters, hoses, pipes, lines, nuts, bolts, hardware, drive chains, sprockets, belts, valve seals and guides, any and all fluids, lubricants and reservoirs, fuses, relays, brake pads, brake shoes, brake rotors and drums, light bulbs, instrument cluster and instrument cluster lighting, radios, amps, speakers and wiring, seats, remotes, key fobs, satellite GPS receivers, TPMS sensors, tires, wheels or rims.

  • Any repair covered by any factory or dealer warranty, repair facility guarantee or other insurance coverage

  • Non-factory or aftermarket performance parts or equipment

  • Any repair when it is reasonably determined that there is a mechanical probability that the condition causing the failure existed prior to the start of the booking.

  • Any repair if a non authorized performance part or equipment caused or contributed to the breakdown

  • Repairs prohibited by federal, state or local law, regulation other authority or agency

  • Expenses for any maintenance service specified in your owners manual, fuels, lubricants and improper repairs

  • Minor loss of fluid or seepage from any seal or gasket is considered normal and is not considered a failure.

  • Any repair cost: if (I) if the odometer has been altered, disconnected or inoperable so that the miles traveled can not be accurately determined . (II) if the vehicles factory warranty has been voided for any reason: or (III) if you fail to provide all maintenance records for routine maintenance relating to covered parts that sustain a breakdown.

  • Negligence, error, or omission on the part  of any servicing dealer, repair facility or provider of road side assistance.

  • Any service that the manufacturer recommends pursuant to a service bulletin or recall notice that applies to your vehicle, and any breakdown of an otherwise covered part if you fail to have the vehicle repaired pursuant to a notice of recall or service bulletin and such repair would have prevented the breakdown.

 Loss of Use Coverage

In the event of an insurance claim occurring over the course of a transaction on Riders Share, Owners under the Premium plan will be reimbursed for up to 14 days of loss of use. Once we’ve determined the reasonable period for your vehicle repairs, we’ll multiply your average daily earnings for the vehicle over the past 60 days by that period. We count back 60 days beginning on the day prior to the start of the trip during which the damage occurred. Total average daily earnings only include earnings from trip price.

 If your vehicle doesn’t have enough trip history to generate average earnings over the last 60 days, we’ll provide you with the minimum payout of $25. If the total average earnings that you’d be compensated is less than $25, we’ll provide you with the minimum payout of $25.

 

FOR RENTERS

PER RIDERS' TERMS OF SERVICE RENTER AGREES AND ACKNOWLEDGES THAT RENTER’S FINANCIAL RESPONSIBILITY IS PRIMARY WITH REGARDS TO DAMAGES, INJURIES, OR LOSSES THAT ARE INCURRED DURING YOUR RENTAL

 

As further discussed in the Renter Terms, as a Renter you acknowledge and agree that you are responsible for your own acts and omissions, as well as the acts and omissions of any individuals who you invite to, or otherwise provide access to the motorcycle.

Any Passengers you provide access to must have agreed and accepted these Riders Share terms including the passenger policy.

You are responsible for any and all damages incurred during the rental period and return of the vehicle according to your Reservation Agreement in a timely manner, in the condition in which it was rented.

Damage Waiver prices are displayed after a user creates an account and clicks the Book button.

Certain types of damage may be excluded from protection, such as unauthorized off-road or illegal usage, and you agree and accept that you assume all obligation to review the Terms of Service.

Protection does not extend to vehicles entering Mexico.

Deductibles 

Renters who purchase damage protection will be required to leave a deposit for the selected deductible amount. This Physical Damage Protection is subject to a $100 to $4,000 comprehensive and collision protections deductible, except for a comprehensive loss due to theft which is subject up to a $5,000 deductible if there is negligence (such as abandoning the motorcycle or leaving the keys on the vehicle). Rides Share may charge the full amount of the deductible as soon as damage to the motorcycle is reported. In the event that the actual damage is less than the charged deductible, Riders Share will refund the difference between the damage amount and the charged deductible. Any physical damage payment by us will be reduced by the applicable deductible. Riders Share is responsible for collecting deductible payment from Renter.

 

Damage Fee

In the event of any loss or damage to the vehicle, or any personal property or bodily injury claim, that occurs during the rental period due to any cause regardless of fault, including, but not limited to, collision, rollover, theft, vandalism, seizure, fire, flood, hail or other acts of nature or God, the renter is held responsible, and is required to pay Riders Share a fee of $150. In the event a renter has violated Riders Share's Terms of Service the renter may be held responsible for the full amount of the claim.

 

Exclusions

 

Personal Belongings

Personal belongings left in or on the vehicle are not insured. These include tapes, records, discs or other similar audio, visual or data electronic devices, or any speed measuring equipment within the vehicle. It is the responsibility of the owner and renter to ensure they remove any personal belongings from the auto before and after each rental.

No Permissive Drivers

We provide insurance for our members only. As per Riders Share's Terms of Service, Riders Share motorcycles may only be driven by the Renter. Passengers may be carried to the extent they have been listed in the Reservation or Rental Agreement according to the Renter Terms.

Permissible Uses Only

Riders Share Insurance does not cover inherently risky activities such as sport or stunt-riding (ie. Wheelies, riding in manner other than that intended by manufacturer. Or driving on unpaved roads or undesignated roadways (i.e., “off-roading,” unfinished roads, racetracks, or sidewalks). For further reference consult the Prohibited Activities Section of the Renter policy. 

Personal Usage Only

Physical damage protection applies to motorcycles rented for personal use only. 

Wear and Tear Policy

There is no way around it, riding a motorcycle results in wear and tear. It’s just part of taking a motorcycle out on the road. Just like other rental companies and likely your own insurance, wear and tear is not covered by Riders Share. In some cases, you can request reimbursement from the Renter where the owner and renter come to an agreement to do so. 

 

Wear and Tear Definition

  • Dings, dents, and scratches to the motorcycle body and components such as body work, paint, frame, windshields, headlights, handlebars, seats, etc. that are 0.5 inches in diameter/length or less; 

  • Weathering or deterioration to fabric;

  • Tire sidewall cracks or deprecated tread from use over time;

  • Any mechanical or suspension component unless it’s caused by an impact with an object (e.g., engines, transmissions, brakes, exhaust systems);

  • Any other cosmetic damage that does not impair the operation and safety of the vehicle and/or is designed or anticipated to wear down during use of the vehicle. 

  • Wear and tear also includes damage to accessories that do not render the accessory inoperable. 

 

Riders Share Support

Per our Terms of Service, Riders Share does not offer protection against wear and tear. Nonetheless, Riders Share makes its best efforts to provide quality and reasonable support to renters and owners.  Typical assistance offered on a case-by-case basis, but in no way guaranteed, is described below:

Cosmetic Damage - In the event that the cosmetic damage is major as determined by Riders Share, we may elect to pay the owner up to the total cost of repair or replacement as appraised by Riders Share.

Paint Replacement - Cost of painting is limited to the cost of a new factory paint job for the damaged component or components as determined by Riders Share. 

Accessories

Cosmetic damage to accessories (i.e., damage that does not render the accessory inoperable) is covered by Riders Share at Riders Share's discretion. Any coverage may be subject to depreciation of the damaged accessory. However, Owners are entitled to request reimbursement from the Renter as part of their Rental Agreement. 

Accessories Definition

Accessories include items such as luggage, crash bars, device mounts, tool kits, and vehicle locks, or other decorative components not part of the OEM factory condition of the motorcycle. 

 

Riders Share Support

Owners are entitled to request Reimbursement from the renter as part of the rental agreement. 

At its own discretion, and only when unable to collect the Reimbursement from the Renter, Riders Share may elect to pay the owner up to 50% of the value of the accessory cosmetic damage or damage that in some way impairs the operation of the accessory. 

In the event that the accessory is rendered inoperable, at its own discretion, and only when unable to collect Reimbursement from the Renter, Riders Share may elect to pay the owner up to the full amount of the cost of replacement for the accessory. Helmet replacement is limited to a maximum of $200 per helmet.

  

Acceptance

You agree to and accept these terms regarding the Riders Share Insurance Policy, and you have reviewed and agreed to all referenced terms above. Any additional questions you may have regarding Insurance coverage may be directed to info@Riders-Share.com. Your continued use of this platform, and agreements manifested therefrom denote your acceptance of these terms.
